Over the past decade, umbilical cord blood (UCB) has routinely been used as a source of haematopoietic stem cells for allogeneic stem cell transplants in the treatment of a range of malignant and non-malignant conditions affecting children and adults. UCB banks are a necessary part of the UCB transplant program, but their establishment has raised a number of important scientific, ethical and political issues. This paper examines the scientific and clinical evidence that has provided the basis for the establishment of (...) UCB banks. We also discuss the major ethical issues that UCB banks raise, including ownership of cord blood, processes for obtaining consent for its collection and storage, and confidentiality. Finally, we review other concerns about commercial non-altruistic banking, including concerns about social justice, equity of access and equity of care. (shrink)

Informed consent in medical practice is essential and a global standard that should be sought at all the times doctors interact with patients. Its intensity would vary depending on the invasiveness and risks associated with the anticipated treatment. To our knowledge there has not been any systematic review of consent practices to document best practices and identify areas that need improvement in our setting. A presente comunicação pretende fazer uma análise da interface entre as leituras de Hacking sobre uma possível relação de continuidade ou ruptura entre e com Latour e Bachelard. Desse modo, é através do conceito de epistemologia que pretendemos entender o racionalismo regional na construção da objetividade científica, partindo de uma suposta subjetividade que pode se reter na perspectiva epistemológica. Com isso, pretendemos elaborar o experimento de pensamento proposto de Latour de colocar o conhecimento em laboratório antropológico das ciências em contraposição (...) à metaepistemologia proposta por Ian Hacking. Assim, tal experimento pretende nos colocar em uma encruzilhada conceitual da ontologia histórica e, com isso, entender talvez quais as saídas possíveis que o bachelardismo pode manter nas questões propostas. It is still a widespread assumption that metaphysics and ontology deal with roughly the same questions. They are supposed to be concerned with the fundamental nature of reality and to give an account of the meaning of 'existence' or 'being' in line with the broadest possible metaphysical assumptions. Against this, Markus Gabriel proposes a radical form of ontological pluralism that divorces ontology from metaphysics, understood as the most fundamental theory of absolutely everything. He argues that the concept of existence is (...) incompatible with the existence of the world and therefore proposes his innovative no-world-view. In the context of recent debates surrounding new realism and speculative realism, Gabriel also develops the outlines of a realist epistemological pluralism. His idea here is that there are different forms of knowledge that correspond to the plurality of fields of sense that must be acknowledged in order to avoid the trap of metaphysics. (shrink)

Those who wish to claim that all facts about grounding are themselves grounded (“the meta-grounding thesis”) must defend against the charge that such a claim leads to infinite regress and violates the well-foundedness of ground. In this paper, we defend. First, we explore three distinct but related notions of “well-founded”, which are often conflated, and three corresponding notions of infinite regress. We explore the entailment relations between these notions. We conclude that the meta-grounding thesis need not lead to tension with (...) any of the three notions of “well-founded”. Finally, we explore the details of and motivations for further conditions on ground that one might add to generate a conflict between the meta-grounding thesis and a well-founded constraint. We explore these topics by developing and utilizing a formal framework based on the notion of a grounding structure. (shrink)

What is it for a picture to depict a scene? The most orthodox philosophical theory of pictorial representation holds that depiction is grounded in resemblance. A picture represents a scene in virtue of being similar to that scene in certain ways. This essay presents evidence against this claim: curvilinear perspective is one common style of depiction in which successful pictorial representation depends as much on a picture's systematic differences with the scene depicted as on the similarities; it cannot be analyzed (...) in terms of similarity alone. The same problem arises for many other kinds of depiction. The essay concludes that depiction in general is not grounded in resemblance but geometrical transformation. (shrink)

Groups are ubiquitous in our lives. But while some of them are highly structured and appear to support a shared intentionality and even a shared agency, others are much less cohesive and do not seem to demand much of their individual members. Queues, for example, seem to be, at a given time, nothing over and above some individuals as they exemplify a certain spatial arrangement. Indeed, the main aim of this paper is to develop the more general thought that at (...) a given time, a group is nothing over and above some individual members as they exemplify a certain complex condition. The general conception of groups that emerges is able to accommodate a variety of constraints on a reasonable answer to the question of what are groups. (shrink)

We criticize attempts to define hope in terms of other psychological states and argue that hope is a primitive mental state whose nature can be illuminated by specifying key aspects of its functional profile.

Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. Philosophers often explain what could be the case in terms of what is, in fact, the case at one possible world or another. They may differ in what they take possible worlds to be or in their gloss of what is for something to be the case at a possible world. Still, they stand united by the threat of paradox. A family of paradoxes akin to the set-theoretic antinomies seem to allow one to derive a contradiction from apparently plausible principles. (...) Some of them concern the interaction between propositions and worlds, and they appear to afford the means to map classes of propositions into propositions – or, likewise, classes of worlds into worlds – in a one-to-one fashion that leads to contradiction. Yet another family of paradoxes threaten the view that whatever could exist does, in fact, exist, which is in line with modal realism, for example. This article aims to survey and identify the source of each family of paradoxes as well as to outline some responses to them. (shrink)

When viewed as the most comprehensive theory of collections, set theory leaves no room for classes. But the vocabulary of classes, it is argued, provides us with compact and, sometimes, irreplaceable formulations of largecardinal hypotheses that are prominent in much very important and very interesting work in set theory. Fortunately, George Boolos has persuasively argued that plural quantification over the universe of all sets need not commit us to classes. This paper suggests that we retain the vocabulary of classes, but (...) explain that what appears to be singular reference to classes is, in fact, covert plural reference to sets. (shrink)

The doctrine that whatever could exist does exist leads to a proliferation of possibly concrete objects given certain principles of recombination. If, for example, there could have been a large infinite number of concrete objects, then there is at least the same number of possibly concrete objects in existence. And further cardinality considerations point to a tension between the preceding doctrine and the Cantorian conception of the absolutely infinite. This paper develops a parallel problem for a variety of possible worlds (...) accounts of modality which eschew the commitment to a plethora of possibly concrete objects. Moreover, the difficulty is importantly different from more familiar threats of paradox exemplified by certain descendants of Russell's paradox of propositions and Kaplan's paradox. (shrink)

This essay argues for a model of pictorial representation which aims to explain the relationship between pictorial content and pictorial accuracy. Focusing on cases where pictures are intended to convey accurate information, the model distinguishes between two fundamental representational relations: on one hand, a picture expresses a content; on the other, it aims at a target scene. Such a picture is accurate when the content it expresses fits the target scene it aims at. In addition, the model follows the traditional (...) division of content into two aspects: singular content specifies the particular individuals which a picture is of, and attributive content specifies the properties and relations which the picture ascribes to those individuals. For a picture to be accurate, both aspects must be matched in the target. I call this the Three-Part Model because it distinguishes between the triad of factors, singular content, attributive content, and target, which together determine pictorial accuracy. Though previous work on depiction has not recognized the distinctive role played by target, I will argue that it is essential in order to make sense of accuracy judgements across a range of central cases. This article seeks to contribute to a vision for leadership in business based on a recovery of virtue. The vision for leadership articulated here draws principally on the writings of the classical philosopher Aristotle and of the contemporary philosopher Josef Pieper. Without discounting the ever-increasing complexity of modern business, this essay will attempt to reconstruct Aristotle’s emphasis on virtue and moral character, and argues for the philosopher’s relevance to modern management and corporate leadership. The paper concludes that the message of (...) virtue is a message of hope and attempts to find plain language to articulate its value to those engaged in business or concerned with the formulation of government policy. In recent years, many disciplines have become interested in the scientific study of morality. However, a conceptual framework for this work is still lacking. In The Moral Background, Gabriel Abend develops just such a framework and uses it to investigate the history of business ethics in the United States from the 1850s to the 1930s. According to Abend, morality consists of three levels: moral and immoral behavior, or the behavioral level; moral understandings and norms, or the normative level; and the (...) moral background, which includes what moral concepts exist in a society, what moral methods can be used, what reasons can be given, and what objects can be morally evaluated at all. This background underlies the behavioral and normative levels; it supports, facilitates, and enables them. Through this perspective, Abend historically examines the work of numerous business ethicists and organizations--such as Protestant ministers, business associations, and business schools--and identifies two types of moral background. "Standards of Practice" is characterized by its scientific worldview, moral relativism, and emphasis on individuals' actions and decisions. The "Christian Merchant" type is characterized by its Christian worldview, moral objectivism, and conception of a person's life as a unity. The Moral Background offers both an original account of the history of business ethics and a novel framework for understanding and investigating morality in general. (shrink)

Do mereological fusions have their parts necessarily? None of the axioms of non-modal formulations of classical mereology appear to speak directly to this question. And yet a great many philosophers who take the part-whole relation to be governed by classical mereology seem to assume that they do. In addition to this, many philosophers who make allowance for the part-whole relation to obtain merely contingently between a part and a mereological fusion tend to depart from non-modal formulations of classical mereology at (...) least when it comes to the axiom of Unique Fusion, which states that no two different mereological fusions ever fuse exactly the same objects. This is no coincidence. There are reasons of principle why one’s adherence to classical mereology should exert some pull towards the view that mereological fusions have their parts necessarily. There is, however, no direct route from the combination of classical mereology and propositional modal logic to the hypothesis that the part-whole relation obtains necessarily between a part and a mereological fusion. In order to bridge between a modal formulation of classical mereology and the hypothesis that fusions have their parts necessarily, one needs to strengthen the axiom of Unrestricted Fusion in a way that is agreeable to many philosophers on both sides of the debate. To achieve impact, academics need to create personal impact development plans, focused on what and on whom to have an impact and the necessary competencies to do so. Profession and university leaders play a critical role in the successful implementation of such plans.

Sociologists often ask why particular groups of people have the moral views that they do. I argue that sociology’s empirical research on morality relies, implicitly or explicitly, on unsophisticated and even obsolete ethical theories, and thus is based on inadequate conceptions of the ontology, epistemology, and semantics of morality. In this article I address the two main problems in the sociology of morality: (1) the problem of moral truth, and (2) the problem of value freedom. I identify two ideal–typical approaches. (...) While the Weberian paradigm rejects the concept of moral truth, the Durkheimian paradigm accepts it. By contrast, I argue that sociology should be metaphysically agnostic, yet in practice it should proceed as though there were no moral truths. The Weberians claim that the sociology of morality can and should be value free; the Durkheimians claim that it cannot and it should not. My argument is that, while it is true that factual statements presuppose value judgments, it does not follow that sociologists are moral philosophers in disguise. Finally, I contend that in order for sociology to improve its understanding of morality, better conceptual, epistemological, and methodological foundations are needed. (shrink)

This essay calls attention to a set of linguistic interactions between counterfactual conditionals, on one hand, and possibility modals like could have and might have, on the other. These data present a challenge to the popular variably strict semantics for counterfactual conditionals. Instead, they support a version of the strict conditional semantics in which counterfactuals and possibility modals share a unified quantificational domain. I’ll argue that pragmatic explanations of this evidence are not available to the variable analysis. And putative counterexamples (...) to the unified strict analysis, on careful inspection, in fact support it. Ultimately, the semantics of conditionals and modals must be linked together more closely than has sometimes been recognized, and a unified strict semantics for conditionals and modals is the only way to fully achieve this. The study aims at expanding the idea of knowledge beyond the notion of descriptive knowledge. It examines a pluralism of scientific, philosophical, literary, and aesthetic forms of knowledge. This pluralism is not relativistic but complementary. Different ways of knowing enrich each other thus facilitating a more comprehensive and differentiated conception of the world.".

When does a model explain? When does it promote understanding? A dominant approach to scientific explanation is the interventionist view. According to this view, when X explains Y, intervening on X can produce, prevent or alter Y in some predictable way. In this paper, I argue for two claims. First, I reject a position that many interventionist theorists endorse. This position is that to explain some phenomenon by providing a model is also to understand that phenomenon. While endorsing the interventionist (...) view, I argue that explaining and understanding are distinct scientific achievements. Second, I defend a novel theory of scientific understanding. According to this view, when some model M promotes understanding, M makes available a distinctive mental state. This state is of the same psychological kind as when we grasp events in a narrative as bearing on some ultimate conclusion. To conclude, I show that, given this view, mechanistic explanations often provide a powerful source of understanding that many causal-historical models lack. This paper will be of interest to both philosophers of science and epistemologists engaged in the topics of explanation and understanding. (shrink)

Während die Bedeutung Freges für die Philosophie der Gegenwart, soweit sich diese der analytischen Philosophie verpflichtet fühlt, allgemeine Anerkennung gefunden hat, ist seine Stellung innerhalb der eigenen Zeit noch weitgehend unaufgeklärt geblieben. So herrscht die Auffassung vor, Frege habe seine Ideen ganz aus sich selbst oder geradezu im Gegensatz zur deutschen philosophischen Tradition seiner Zeit gewonnen. Bei genauerer Textanalyse weisen Freges Schriften dagegen vielfältige Beziehungen zur zeitgenössischen Logik, Erkenntnistheorie, Sprachphilosophie und Philosophie der Mathematik auf, so dass bei ihm von einem (...) Bruch mit der kontinentalen Philosophie nicht die Rede sein kann. Weil die historischen Voraussetzungen unberücksichtigt geblieben sind, ist ein unzutreffendes Bild von Freges Einsichten entstanden. Dieses Bild wird durch die Entfaltung des historischen Kontextes korrigiert. Bestimmend ist dabei ein problemorientierter Zugang, der sich systematischer Bewertungen und Weiterführungen nicht enthält. (shrink)

The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. The Kohlberg Gilligan Controversy has received intermittent but inconclusive attention for many years, perhaps reflecting the difficulty of bridging the two positions. This article explores the published evidence for Gilligan's claims of gender difference, gender identity difference, and role of caring in people's ethics. It seems that the evidence for pronounced gender differences in ethical attitudes within business is weak, even if gender identity is used instead of physical gender. The main propositions of Care Theory and recent advances in its (...) thinking are discussed. Special focus emerges on the notion of Attachment which seems to be the Care Theory ingredient both most able to survive critical scrutiny and most promising for bridging the divide between the Kohlberg and Gilligan paradigms. The Social Bonding Model and other possible bridge building conceptual structures are introduced. Finally, Max Weber's division between ethics of conviction and ethics of responsibility provides an overarching perspective both of the gap still to be bridged and the need to keep trying to bridge it. Siguiendo el hilo de las Líneas fundamentales de la Filosofía del Derecho, se empieza por ver el derecho al bienestar, tal como se formula en la Moralidad (1). En la familia aparece el derecho de los hijos "de ser alimentados y educados" (2). El Derecho al bienestar se concreta en la sociedad civil (3), se (...) hace posible en el sistema de las necesidades (3.1.) y efectivo en la policía y la corporación (3.2 y 3.3), que ejercen funciones de suplencia de la familia. El mayor problema es la pobreza, tanto la que surge por contingencias subjetivas y sociales como por el funcionamiento mismo de la sociedad civil: la plebe. This paper appeals to the phenomenon of dreaming to provide a novel defense against arguments from evil. The thrust of the argument is as follows: when we wake up after a nightmare we are often filled entirely with relief, and do not consider ourselves to have actually suffered very much at all; and since it is epistemically possible that this whole life is simply a dream, it follows that it is epistemically possible that in reality there is very little suffering. This paper looks at the question of what regions of space are possibly exactly occupied by a material object.

The history of the field of business ethics in the U.S. remains understudied and misunderstood. In this article I begin to remedy this oversight about the past, and I suggest how it can be beneficial in the present. Using both published and unpublished primary sources, I argue that the business ethics field emerged in the early twentieth century, against the backdrop of the establishment of business schools in major universities. I bring to light four important developments: business ethics lectures at (...) the University of California and Yale University, Leon Marshall’s curriculum at the College of Commerce of the University of Chicago, and the William A. Vawter Foundation on Business Ethics at Northwestern University. Then, I consider the payoffs of my historical account for business ethics theory, pedagogy, and practice. Specifically, I present four implications of my account under these headings: business ethics as a public problem; the place of ethics in business schools; historicizing business ethics; and historical self-knowledge. The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

In this article I ask what recent moral psychology and neuroscience can and can’t claim to have discovered about morality. I argue that the object of study of much recent work is not morality but a particular kind of individual moral judgment. But this is a small and peculiar sample of morality. There are many things that are moral yet not moral judgments. There are also many things that are moral judgments yet not of that particular kind. If moral things (...) are various and diverse, then empirical research about one kind of individual moral judgment doesn’t warrant theoretical conclusions about morality in general. If that kind of individual moral judgment is a peculiar and rare thing, then it is not obvious what it tells us about other moral things. What is more, it is not obvious what its theoretical importance is to begin with—that is, why we should care about it at all. In light of these arguments, I call for a pluralism of methods and objects of inquiry in the scientific investigation of morality, so that it transcends its problematic overemphasis on a particular kind of individual moral judgment. While much has been written on phronesis, there is a dearth of empirical work on the how the concept can be developed and implemented in practice, particularly in an educational setting. To address this problem, characteristics of phronesis were identified through a review of current literature and an examination of related themes from a special issue of the Philosophy of Management Journal on the philosophy of innovation. The implementation of the concept was investigated using an illustrative study of ongoing work (...) aimed at embedding phronesis in an innovation educational module. The study will contribute to the nascent debate by providing evidence of embedding Aristotle’s phronesis in the curriculum of future managers, in this case Engineering and Business students, working in cross-functional teams. A schema is proposed, based on concepts distilled from the literature and the illustrative study, to examine whether an educational project cultivates phronesis among the students. (shrink)

This paper draws a distinction between the existential quantifier and the symbol ‘∃’ used to express it, on the one hand, and existence and ‘exists’, on the other. It argues that some popular arguments in metaphysics, including arguments against vague existence and arguments against deflationary metaontology (which views ontological disputes as lacking substance), are guilty of fudging this distinction. The paper draws some lessons for metaphysical debate about existence and highlights some heretofore ignored and attractive positions in logical space.

We present two studies investigating the impact of causal perceptions and the moral emotions of anger, shame, and guilt on the justification of deviant workplace behavior. Study 1 tests our conceptual framework using a sample of undergraduate business students; Study 2 examines a population of practicing physicians. Results varied significantly between the two samples, suggesting that individual and contextual factors play an important role in shaping the perceptual and emotional processes by which individuals form reactions to undesirable affective workplace events. Still, one of the main achievements of [12] consisted in establishing that a characterization of these models can be attained when one ventures into second-order logic. For let second-orderZFbe, as usual, the theory that results fromZFwhen the axiom schema of replacement is replaced by its second-order universal closure. The financial crisis has led to new interest in the ethics of financial markets. In this article, we further the debate on the nature of banking contracts by showing that the fundamental subjective purposes of loan and deposit contracts are irreconcilable. Any resultant mixture of the two contracts is a legal aberration. We consider a mutual fund as an important and legitimate alternative to the common demand deposit to provide high liquidity and some yield without offering full availability of a (...) nominal sum. Besides being a close substitute for how many deposit accounts function today, the mutual fund has the additional benefit of satisfying all legal and ethical requirements. Loan and investment contracts allow for the “bank” to make use of their clients’ funds while the intents of money owners are clearly classified without running into legal or ethical problems. (shrink)
